The state of emergency in Rivers State raised more questions about the extent of presidential powers when declaring emergency rule. Section 305 of Nigeria’s 1999 Constitution sets out those powers with striking clarity. Yet time and again, Nigerian courts have avoided definite answers, finding refuge in procedural hedges and technicality.
